Terms & Conditions
1. General
1.1 These terms and conditions apply to all sales of goods (each a product) by Beast Health Australia (BeastHealth.com.au) and Beast Health New Zealand (BeastHealth.co.nz), which are operated and distributed by Global Shop Direct Pty Ltd (Seller) to the purchaser of the Product (Customer).
1.2 A provision or provisions of these terms and conditions can only be waived in writing signed by an authorised officer of Seller and will prevail over all of Customer’s terms and conditions to the extent of any inconsistency.
2. Quotations and orders
2.1 By placing an order for a Product with Seller (Order), Customer offers to purchase that Product at the price specified in the Order. Seller reserves the right to accept or reject any Order within 7 days of receiving the Order. Any ad or webpage publishing the availability of a Product and its price is an invitation to treat only.
2.2 Seller is not obliged to supply any Product until Seller accepts the Order for that Product. If Seller rejects an Order, Seller will refund any amount paid in advance by Customer for the Order.
2.3 If Customer breaches any of these terms and conditions in respect of an Order, Seller may:
(a) at any time cancel or suspend all or some of the Orders placed by Customer; and
(b) vary the terms and conditions of supplying incomplete and/or future Orders by Customer without prior notice to Customer and without Seller incurring any liability.
3. Price and payment
3.1 The published price for Products for shipping to Australian or New Zealand shipping addresses (Purchase Price) includes the Goods and Services Tax (GST) but, unless otherwise expressly stated, does not include any postage, handling, freight, insurance, customs charges and other charges in relation to the Product (P&H).
3.2 Payment for the goods which you order must be made by one of the payment method options listed on the website which may change from time to time. Payment will be charged at the time of Seller receiving your order and prior to the time that the goods are dispatched and received by you. Seller will provide you with an invoice number as confirmation of the order. If your payment is rejected by the card issuer or payment provider your order will not be dispatched. Payment is made at your own risk.
3.3 If Customer has paid all or part of the Purchase Price before cancellation of an Order, for any reason whatsoever, Seller will be entitled to set off that part of the Purchase Price that has been paid against any other amounts owed by Customer to Seller on any account whatsoever, whether or not the Products the subject of the cancelled Order were delivered to Customer, and not withstanding any money back guarantee.
3.4 Seller may charge interest on any overdue moneys outstanding from time to time at the rate which is 6% per annum above the Cash Target Rate of the Reserve Bank of Australia applying on the Due Date, calculated from the Due Date until the date of payment.
3.5 Customer agrees to pay Seller any expenses (including legal costs) reasonably incurred by or on behalf of Seller in collecting any outstanding debts due by Customer to Seller.
3.6 Any payment made by Customer will be credited first to any such expenses referred to in clause
3.5, then to any interest that has accrued and finally to the outstanding portion of the Purchase Price.
4. Shipping
4.1 Any shipping times notified to Customer are estimates only and Seller is not liable for late or non-shipping.
4.2 Seller may, at Customer’s request, agree to postpone shipping of the Product to a time more convenient to Customer provided that Customer pays to Seller an amount reasonably determined by the Seller in its discretion as a pre-estimate of its additional costs of administration, handling, shipping and storage.
5. Title and risk
5.1 The risk of loss or damage to the Product passes to Customer on dispatch of the Product from the Seller’s warehouse for shipping to Customer by post or other means.
5.2 Notwithstanding shipping of the Product to Customer, title in the Product will not pass to Customer until the full amount of the Purchase Price is received by Seller in cleared funds. If Customer’s payment is not received or is declined for any reason, Seller reserves the right to reclaim the Product from Customer’s possession, custody or control at Customer’s cost even if it has been delivered to Customer or moved from the shipping address. Customer irrevocably grants to Seller the right to enter any premises occupied or controlled by Customer for the purpose of seizing any Product for which payment in full has not been made. Seller reserves the right to keep or sell the Product.
5.3 This clause 5 creates a purchase money security interest for the purposes of the Personal Properties Securities Act 2009 (Cth) (PPSA) (Australia) or the Personal Property Securities Act 1999 (the PPSA) (New Zealand). To the extent permitted under the PPSA, Buyer agrees to contract out of the provisions listed in section 115 of the PPSA which impose a burden on Seller. Buyer waives its right to be provided with verification statements under section 157 of the PPSA.
6. 30 Day Money Back Guarantee
6.1 Clauses 6 and 7 do not affect the Customer’s rights under the Australian Consumer Law (ACL) and equivalent state legislation, or customer rights under the New Zealand Consumer Guarantees Act and New Zealand Consumer Law which may not be excluded or varied by agreement (Consumer Rights), for example the right to return a product which suffers from a major failure as defined in the ACL or in the NZ Guarantees Act
6.2 Subject to this clause 6 and provided clause 8 is complied with, Customer may, if not satisfied with the Product for any reason, return the Product to Seller within 30 days (or such other period as may be expressly provided in an offer) after the date of invoice.
6.3 This 30 Day Money Back Guarantee does not give Customer the right to return a Product damaged in transit, by abuse or improper or abnormal usage by Customer or a third party, or a Product damaged by a repair provided by a person not authorised by Seller.
6.4 No refund will be payable to Customer until Seller has inspected the returned Product and determined that the terms of this 30 Day Money Back Guarantee have been satisfied.
6.5 These 30 Day Moneyback Guarantee terms strictly apply only to products purchased directly on the Beast Health website. Products purchased through external retailers, retailer websites, marketplaces or other means are subject to the terms of those retailers.
7. Damaged Products
7.1 Customer must inspect the Product on delivery and satisfy itself that the Product has not been damaged in transit. If the Product appears to be damaged, Customer must notify Seller within 48 hours of receiving delivery and must provide evidence of the damage, such as by way of photographs.
7.2 Seller does not accept liability for Products lost or damaged in transit or by Customer. However, depending on how the loss or damage occurred, Seller may in its absolute discretion provide a remedy or assistance to Customer.
7.3 Customer must comply with the requirements of clause 8.1 when returning any damaged Product under clause 7.
8. Return of Products
Pursuant to 30 Day Money Back Guarantee
8.1 Any return of Products under clauses 6 or 7 must be in accordance with the following terms:
a) Customer must contact Seller’s Customer Service Centre via the Contact Us page on the Beast Health website and obtain a Return Authorisation Number. Seller will give Customer an address for return of the Product.
b) Customer must return the Product in its original packaging, with all original accessories and contents, by registered post to Seller within 30 days of the date of invoice to obtain a refund or, in the case of damaged Products, at the discretion of Seller, a replacement Product.
c) Refunds and returns or replacements do not include any shipping cost, and all such charges are at Customer’s cost, unless Seller otherwise agrees in writing. Seller reserves the right to refuse to accept any returned Products in respect of which the Customer has not paid the full shipping back charges for example, those marked “Cash or cheque on delivery” or “More to pay”.
d) Except where required by law or in accordance with these terms and conditions, Seller is not obliged to accept any return of Products. If Seller does not accept the return of the Product, Seller will contact Customer in writing.
e) Nothing in this clause 8.1 affects the Consumer Rights of Customer.
Pursuant to Consumer Rights
8.2 Where Customer is entitled to return the Product pursuant to Customer's Consumer Rights, the Seller will at its option, having regard to the relevant Consumer Right, and depending on the nature and size of the Product:
a) Send a reply paid label to Customer to enable Customer to post the Product back to Seller at the cost of Seller,
b) Arrange for Product to be collected from Customer,
c) Instruct Customer to destroy or otherwise safely dispose of the Product and send to Customer a replacement Product free of charge to Customer, or
d) Refund the purchase price in full including shipping cost to Customer.
9. Limitation of liability
9.1 To the maximum extent permitted by law, all terms, guarantees, warranties, representations or conditions which are not expressly stated in these Terms and Conditions or in a written warranty from Seller are excluded. If Seller is liable for breach of an imposed term, guarantee, warranty, representation or condition, Seller’s liability is, at Seller’s option, to the extent permitted by law, limited to:
(a) the replacement of the Products or the supply of equivalent products;
(b) the repair of the Products;
(c) the payment of the cost of replacing the Products or acquiring equivalent products; or
(d) the payment of the cost of having the Products repaired.
9.2 To the maximum extent permitted by law, Seller is not liable for any special, indirect or consequential loss or damage, loss of profit or opportunity and loss of data arising out of or in connection with the Products, including as a result of not being able to use the Products or the late or non-supply of Products, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise and whether or not Seller was aware that such loss or damage may occur.
